01 / TERMS OF HIRE
Please read these terms before confirming a booking. They explain how trade dry hire works, the responsibilities attached to your hire, and the terms that apply to all bookings.
01 / FORMATION OF AGREEMENT
1.1. Upon approval signature or email reply by the Client to the quote provided by Artisan Productions Ltd (trading as The Gear House), the rental agreement is formed. 1.2. The Client agrees to abide by the terms and conditions outlined herein upon confirmation of the rental booking.
02 / DEFINITIONS
2.1. “Artisan Productions Ltd” refers to Artisan Productions Ltd (company number 11599738), the equipment rental company providing services under these terms and conditions, trading as The Gear House. 2.2. “The Gear House” refers to the trade dry hire brand under which Artisan Productions Ltd offers the Equipment for hire, and is not a separate legal entity. 2.3. “Client” refers to the individual or entity renting Equipment from Artisan Productions Ltd. 2.4. “Equipment” refers to the audiovisual, lighting, staging and any other equipment rented by the Client from Artisan Productions Ltd. 2.5. “Rental Period” refers to the duration for which the Equipment is rented by the Client.
03 / ELIGIBILITY
3.1. The Gear House offers trade dry hire only. The Client confirms that it is hiring the Equipment for business or professional production purposes and not as a consumer. 3.2. Artisan Productions Ltd may ask the Client to confirm its trade or business status, and may decline a booking where this cannot be confirmed.
04 / RENTAL PERIOD
4.1. The Rental Period begins from the time the Equipment is delivered to the Client or collected by the Client from Unit 2, Hatton Rock Business Centre, Stratford-upon-Avon CV37 0NQ, and ends upon return of the Equipment. 4.2. Any extension of the Rental Period must be agreed in writing by both parties and may be subject to the day and week rates set out in the Client’s quote.
05 / EQUIPMENT CONDITION
5.1. The Client acknowledges that the Equipment is rented in good working condition and agrees to inspect the Equipment upon delivery or collection. 5.2. The Client agrees to return the Equipment in the same condition as received, ordinary wear and tear excepted.
06 / USE OF EQUIPMENT
6.1. The Client agrees to use the Equipment solely for its intended purpose and in accordance with any manufacturer instructions or guidelines provided by Artisan Productions Ltd. 6.2. The Client shall not modify, alter or tamper with the Equipment in any way without prior written consent from Artisan Productions Ltd.
07 / RENTAL CHARGES
7.1. The Client agrees to pay the rental charges specified by Artisan Productions Ltd for the Equipment, plus VAT and any other applicable taxes and fees. 7.2. Rental charges are based on the Rental Period and any additional services requested by the Client. 7.3. Delivery is provided free of charge on orders over £1,000 excluding VAT, mainland UK coverage as standard. A delivery charge applies to orders below this threshold, as confirmed in the Client’s quote.
08 / PAYMENT TERMS
8.1. Payment for Equipment rental charges is due upon confirmation of the rental booking, unless the Client holds an approved trade account with Artisan Productions Ltd, in which case account terms will apply as agreed. 8.2. Artisan Productions Ltd reserves the right to require a security deposit, refunded upon return of the Equipment in satisfactory condition. 8.3. All payments must be made to Artisan Productions Ltd. Payment details are confirmed with each quote; The Gear House does not hold a separate bank account.
09 / DELIVERY AND COLLECTION
9.1. Artisan Productions Ltd will arrange delivery and collection to and from the Client’s specified location, or the Client may collect from and return Equipment to Unit 2, Hatton Rock Business Centre, Stratford-upon-Avon CV37 0NQ. 9.2. The Client agrees to provide clear and safe access for delivery and collection.
10 / LATE RETURN OF EQUIPMENT
10.1. If the Client expects to return the Equipment after the end of the Rental Period, the Client must contact Artisan Productions Ltd as soon as it becomes aware. 10.2. Late returns are charged at the applicable daily rate for each day or part day the Equipment is overdue, plus an administration fee. Artisan Productions Ltd will confirm the charges that apply to the Client’s hire.
11 / LIABILITY AND INSURANCE
11.1. The Client assumes all risk of loss, theft or damage to the Equipment during the Rental Period, with any repair or replacement costs chargeable to the Client. 11.2. The Client agrees to maintain equipment-value insurance cover for the full Rental Period, naming Artisan Productions Ltd as an additional insured party. 11.3. The Client must provide proof of insurance prior to collection or delivery. 11.4. The Client must provide valid photo ID and current proof of address upon collection or receipt. Copies are held securely only to verify identity and administer the hire, in line with Artisan Productions Ltd’s privacy policy.
12 / INDEMNIFICATION
12.1. The Client agrees to indemnify and hold Artisan Productions Ltd harmless from any claims, damages, losses or expenses arising from the Client’s use or misuse of the Equipment.
13 / TERMINATION
13.1. Artisan Productions Ltd reserves the right to terminate the rental agreement and reclaim the Equipment at any time if the Client breaches any provision of these terms and conditions.
14 / GOVERNING LAW
14.1. These terms and conditions are governed by and construed in accordance with the laws of England and Wales, and any disputes arising under them are subject to the exclusive jurisdiction of the courts of England and Wales.
15 / ENTIRE AGREEMENT
15.1. These terms and conditions constitute the entire agreement between Artisan Productions Ltd and the Client with respect to the rental of Equipment, and supersede all prior agreements and understandings, whether written or oral.
